1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of the FishFinderSA mobile application and the website located at www.gofishfinder.co.za (collectively, the "Platform").
The Platform is operated by FishFinderSA (Pty) Ltd ("FishFinderSA", "we", "us", or "our").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Platform.
2. Eligibility
You must be at least 18 years old to use the Platform unless you have parental or legal guardian consent. By using the Platform, you confirm that you meet this requirement.
3. Account Registration
To access certain features, you must create an account. You agree to:
- → Provide accurate and complete information
- → Maintain the confidentiality of your login credentials
- → Notify us promptly of any unauthorized use of your account
You are responsible for all activity that occurs under your account. FishFinderSA reserves the right to suspend or terminate accounts that violate these Terms.
4. Use of the Platform
FishFinderSA provides fishing-related tools including mapping, forecasting, catch logging, and community features. You agree not to:
- → Use the Platform for unlawful purposes
- → Upload false, misleading, or fraudulent content
- → Infringe intellectual property or privacy rights
- → Harass, abuse, or harm other users
- → Attempt to interfere with Platform security, integrity, or functionality
We may remove content or restrict access if these Terms are violated.
5. User-Generated Content
Users may upload content such as photos, fishing logs, comments, and other material ("User Content").
By submitting User Content, you:
- → Confirm that you own the content or have the necessary rights and permissions to submit it
- → Grant FishFinderSA a non-exclusive, royalty-free, worldwide license to host, store, display, reproduce, and make your User Content available within the Platform for its intended functionality
- → Accept responsibility for the legality, accuracy, and appropriateness of your User Content
FishFinderSA does not guarantee the accuracy of User Content and is not responsible for third-party posts.
6. Fishing and Safety Disclaimer
FishFinderSA provides informational tools and forecasts intended to assist anglers. We do not guarantee catch success, forecast accuracy, weather conditions, sea state, safety of fishing locations, or suitability of any fishing activity.
All fishing activities are undertaken at your own risk. Users are responsible for complying with all local fishing regulations, permits, licensing requirements, and safety precautions.
7. Location-Based Features
The Platform may use location services to provide mapping and forecasts. You control location permissions through your device settings.
FishFinderSA is not responsible for inaccuracies in GPS data, third-party mapping services, or external data sources.
8. Payments and Subscriptions
If the Platform offers paid features or subscriptions:
- → Payments are processed through secure third-party providers
- → Prices may change with notice where practical
- → Subscriptions may renew automatically unless cancelled through the applicable app store settings
Refunds are subject to the policies of the Apple App Store or Google Play Store, where applicable.
9. Intellectual Property
All Platform content including logos, software, design elements, branding, text, and graphics is the property of FishFinderSA (Pty) Ltd or its licensors and is protected by applicable intellectual property laws.
You may not copy, reproduce, modify, distribute, or exploit any Platform content without prior written consent.
10. Limitation of Liability
To the maximum extent permitted by law, FishFinderSA shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of revenue, loss of data, or business interruption arising from your use of the Platform.
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
11. Indemnification
You agree to indemnify and hold harmless FishFinderSA (Pty) Ltd, its directors, employees, and affiliates from any claims, damages, liabilities, costs, and expenses arising from:
- → Your use of the Platform
- → Your violation of these Terms
- → Your User Content
12. Termination
We may suspend or terminate access to the Platform at our discretion if you breach these Terms, if we are required to do so by law, or if the Platform is discontinued.
Termination does not limit any legal rights or remedies available to FishFinderSA.
13. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how personal information is collected and processed.
14. Changes to These Terms
We may update these Terms from time to time. Updated versions will be published on our website with a revised effective date. Continued use of the Platform constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of South African courts.
